More Time to Investigate Medical Malpractice

Herber v. Martin Memorial Medical Center, Inc., Florida Fourth DCA, August 2011 -
The Fourth District Court of Appeals recently held that in a medical malpractice case, trial courts cannot require that a reasonable investigation be completed before filing a notice of intent, so long as the investigation is completed prior to the statute of limitations expiring. In most cases, the victim of a medical error has only two years to file a medical malpractice case. Although this ruling appears to provide greater flexibility for victims of medical errors, in order to preserve your rights it is important to hire an attorney with experience investigating medical negligence and malpractice.
