Determination of paternity is a statutory cause of action in Florida and the family law attorneys of Canan Law have extensive experience in paternity cases. Under Florida paternity laws, the mother, father, or child may bring the action. Hearings in paternity cases in St. Johns County courts are usually held in chambers, and persons in attendance may be restricted. Scientific tests may be required of the child, mother, and alleged father. If the tests establish a statistical probability of paternity of 95% or more, a rebuttable presumption of paternity is established. If paternity is found, the court may order the father to pay child support, attorneys’ fees, and cost incident to birth.
