Prenuptial agreements

A Prenuptial Agreement Can Strengthen Your MarriageA prenuptial agreement is made before your marriage to resolve issues of support and property division if the marriage ends in divorce or by death of the spouse. Prenuptial agreements between prospective spouses are generally valid. However, the prenuptial agreement must be in writing and signed by both parties. The basic requirement of a prenuptial agreement is that it must be voluntarily entered into without undue influence or coercion. The prenuptial agreement must also be fair and just, or it must have been entered into after full and fair disclosure or after completion of discovery prior to the marriage. Issues that can be addressed in a prenuptial agreement include but are not limited to alimony and division of marital and non-marital property.

family law

The attorneys at Canan Law provide excellent representation in all areas of family law, including prenuptial agreements. Canan Law attorneys serve the Northeast Florida community, including St. Johns, Putnam, Clay, and Flagler counties. The approach of all Canan Law attorneys is a simple one.  In every case your attorney will do everything that can and should be done to insure that you are in the best possible position to avoid future litigation – an enforceable prenuptial agreement – or to negotiate a settlement or present a contested case to the court in a trial. This is never the simple result of good luck or good intentions. Rather, such results are only made possible by careful, diligent, and thorough attention to all facts and legal issues prior to drafting the prenuptial agreement as well as attention to your concerns and objectives.  In the specialty of prenuptial agreements, Canan Law attorneys possess detailed knowledge of courts in the St. Johns area and the applicable law.

To avoid unpleasant surprises in the future, you should consider letting the family law experts at Canan Law help you draft a fair and equitable prenuptial agreement before your marriage.
