Florida's "Move Over" law and distracted driving

Like other states, Florida has what is commonly referred to as a "Move Over" law. Although most drivers in St. Augustine know they need to pull over for emergency vehicles, the Move Over law goes one step further.

Under the Move Over law, a motorist must give at least one additional lane of berth when approaching a stopped emergency vehicle, like a police car or an ambulance. The same rule applies to vehicles like tow trucks, utility trucks and sanitation vehicles that may be stopped along a multi-lane highway or interstate.

Of course, sometimes it is not possible for a motorist to move over as required and still be safe. In such cases, the motorist may elect instead to slow down considerably, that is, to a speed 20 miles per hour under the speed limit when traveling on the open highway.

While those who are paying attention to the road will likely have little trouble following Florida's law, for drivers who tend to be distracted or inattentive, compliance could prove difficult. After all, distracted drivers may not see an emergency vehicle or other vehicle on the side of the highway until it is too late.

Unfortunately, a lot of distracted driving accidents happen precisely because motorists do not move over when they need to and, thus, cause or contribute to serious high-speed accidents. Many times, these accidents involve people who have left their vehicles to do their jobs.

Accidents of this nature can leave victims seriously injured and perhaps even permanently disabled, assuming they survive the accident at all. Victims will likely need compensation after these types of accidents.
